Terms and Conditions for your stay at a Tarifa Beach House Terms of Service

Website use

These terms set out the terms upon which you may make use of this website and govern your use of the services we (Tarifa Beach Houses) provide through this website. By using our website you acknowledge and confirm that you accept these terms and agree to comply with them. Please read these terms carefully before using the website and you are recommended to make a copy for your future reference.

Our services

We provide an online facility that connects owners who have accommodation to rent with persons seeking to rent such accommodation. We are not and shall not become party to any rental or letting agreement with, or have responsibility for monitoring any transaction between, owners of accommodation and anyone renting or seeking to rent such accommodation nor are we the owner, manager, broker or agent for any of the properties listed on this website.

We do not warrant that our website or its content or functionality will always be available or uninterrupted or that it is free of viruses. We may suspend, withdraw, discontinue, change or modify all or any information at any time without notice and we shall not be liable if for any reason the website or any part of it is unavailable at any time.

The content is provided for general information only and is not to be relied on. Although we make all reasonable endeavours to keep the information (all of which is supplied by accommodation owners) up to date, no representations, warranties or assurances, whether express or implied, are given that it is complete and accurate. Furthermore we are not responsible for any information provided to you directly or indirectly by any owner. Any arrangements that you negotiate or conclude with an owner are your sole responsibility and we accept no liability in relation to any such arrangements to you or any third party.

Accommodation owners’ have the right to accept or reject any application for accommodation and we reserve the right at our sole and complete discretion to reject any application made via this website.

Property Rights

We own or are the licensee of all intellectual property rights in our website and its content. These rights are protected by law and you may not copy or download any content or extract from the website other than for your own personal use or with our express written consent. In the case of downloaded information you may not modify or use the same and you shall indemnify us against any liability that we may incur through your use or modification of such information or your misuse of this website.

You may only use this website for lawful purposes and you shall indemnify us and keep us indemnified

against any unlawful or fraudulent use and any breach of applicable local, national or international laws and regulations.

Limitation of Liability

Under no circumstances shall we be liable for any loss or damage caused by your reliance on information obtained through this website, its content or the services we provide. It is your responsibility to evaluate the accuracy, completeness and usefulness of the website, its content and the services and in no event shall we be liable for any damages whatsoever in respect of your use of the website or our services or any transaction that you enter into with an accommodation owner following use of this website.

Payment

The initial payment required to secure a reservation depends on the individual property and is non- refundable. This payment should be made to the account given. We expect the deposit payment to be paid within 48 hours of receiving the relevant bank details, no booking is secure without receipt of the payment and a booking can be considered as cancelled if the payment has not been received within this time frame.

In the cases where a balance payment is required prior to arrival we expect for this payment to arrive on time and this will be stipulated at the time of booking, Tarifa Beach Houses are entitled to treat your booking as cancelled if you fail to pay the balance on time.

Security Deposits

If applied a security deposit is required to cover the cost of any damage or breakages to, or at the property. The owner or Tarifa Beach Houses reserve the right to refuse entry to the property should the security deposit not have been paid.

The owner or their representative shall be allowed access to inspect the property prior to your departure.

In the case of any damage or breakages, the security deposit will be kept whilst waiting for estimates for repaid or damage.

You are responsible for keeping the property and all its contents in the same state of cleanliness, repair and condition as at the commencement of the holiday. You will be responsible for the payment of any breakages, loss or damage caused by you, your guests or members of your family. The owner reserves the right to make deductions from the security deposit for any extra cleaning, over the number of hours committed to departure cleaning, and to claim against you for damage or loss, if the cost of which exceeds the security deposit.

If you cancel or amend your booking

If you need to cancel or amend your Booking you must write to us or email as soon as possible. A cancellation or amendment will not take effect until we receive confirmation from you.

The effective date of cancellation is the date we receive written notification. If you cancel 8 weeks or more prior to your arrival at the property you will lose your deposit. If you cancel less than 8 weeks before your arrival at the property, or the booking is cancelled due to your non- payment, the Owner shall be entitled to the full cost of the holiday from you. Security deposits are fully refundable in the event of cancellation by you. No refund shall be refunded unless the company is able to re-let the property for the same terms, in which case a full refund shall be repaid to the client (less administration charges).

If the balance payment is not paid in accordance with the time frames set out at the time of the Booking we shall be entitled to treat your booking as cancelled by you.

If you do not arrive at the property within 24 hours of your arrival time without notifying us, we will consider your booking as cancelled by you.

If the owner cancels or amends your booking

In the unlikely event of a significant change or cancellation of your booking by the Owner, we will inform you as soon as possible. If requested and if available the owner will try to arrange alternative accommodation at a similar price, standard and location. In the event that no suitable alternative can be found, the owner shall refund to the client in full the client’s deposit and any such other sums as the client may have paid to Tarifa Beach Houses on the owner’s behalf and neither Tarifa Beach Houses or the owner shall have any further liability whatsoever to the client or his/her party.

The Property

You can arrive at the Property after the time specified by us on the arrival date for your holiday and you must leave by the time specified by us on the departure date we give you. We will let you know these times in writing in advance of your stay.

If your arrival will be delayed, you must contact the person whose details are given on the booking confirmation email so that alternative arrangements can be made. If you fail to do so you may not be able to gain access to the Property.

You must vacate the property by 10am on the day of departure unless other arrangements have been made directly with Tarifa Beach Houses on the Property Owner. Failure to do so will result in money being taken out of the security deposit.

Upon departure it is the guests’ responsibility to ensure that all keys are left at the property. An

administration charge and replacement value of lost items will be deducted from the security deposit in this incidence.

Your obligations

You agree to comply with the regulations set out in any property manual at the Property and any other regulations reasonably specified by us and ensure that they are observed by all members of your party. You agree to keep and leave the Property and the furnishings, including items such as kitchen equipment, crockery and glasses clean and in good condition.

The Owner reserves the right to make deductions from the security deposit for any extra cleaning, over the number of hours committed to departure cleaning, and to claim against you for damage or loss, if the cost of which exceeds the security deposit.

You agree to take all necessary steps to safeguard your personal property while at the Property.

You agree to ensure that each member of your party is covered by comprehensive travel insurance (including cancellation, flight delays, loss and damage to baggage and other property) and health insurance (including evacuation and repatriation coverage).

You cannot allow more people to stay in the Property than expressly authorized, nor can you significantly change the make up of the party during your stay in the Property, nor can you take your pet into the property unless permitted by us in writing in advance. If you do so, we can refuse to hand over the property to you, or we can require you to leave it. We will treat any of these circumstances as a cancellation of the booking by you and we shall be under no obligation to refund you for any fees already paid to us in those circumstances. Any refund will be our sole discretion.

You agree to allow us or any representative of ours access to the Property at any reasonable time during your stay for the purpose of essential repairs, in an emergency or to ensure you are complying with this Booking Contract.

Complaints

Every effort has been made to ensure that you have an enjoyable and memorable holiday. If however you have any cause for complaint it is important that remedial action is taken as soon as possible.

It is essential that you contact us if any problem arises so that it can be speedily resolved. It is often extremely difficult (and sometimes impossible) to resolve problems properly unless we are promptly notified. Discussion of any criticisms with us whilst you are in residence at the Property will usually enable shortcomings to be rectified straight away. In particular, complaints of a transient nature (for example,

regarding preparation of the Property) cannot be investigated unless registered whilst you are in residence at the Property.

If any complaint cannot be resolved during your holiday, you must write to us or email us with full details within 28 days of the end of your Booking.

Car Hire

To make the most of this area we strongly advise car hire. Sports cars are not suitable for the Tarifa country tracks and we would recommend a hardier, tougher kind of cars. Vans and cars higher off the ground are a good option.

Location of the Tarifa Beach Houses

Please familiarise yourself with the location of the property you would like to rent prior to your booking. A google map can be found on the Tarifa Beach House website with this information, if no map has been provided on the site it is the clients responsibility to enquire as to the properties location. A Tarifa Beach House is not necessarily on the beach.

Some properties include end cleaning, should you wish any extra

Gardening and Maintenance

The owner or their representative has the right to access the property during your stay if urgent maintenance is required. Gardeners and maintenance staff may also enter the grounds during your stay.

The Owner reserves the right to make deductions from the security deposit for any extra cleaning, over the number of hours committed to departure cleaning, and to claim against you for damage or loss, if the cost of which exceeds the security deposit.

Events

We are happy to arrange a party / function for you. However, if you intend to organize a function (e.g. party, wedding, cocktail party) at a Tarifa Beach House, you must seek prior permission from Tarifa Beach Houses. Additional charges and / or an increased security deposit may be sought at our discretion. An inventory is provided. Please inform us of any discrepancies / malfunctions within 24 hours of arrival, after which time you will be deemed to be responsible.

Air Conditioning

Where applicable as only a few of the Tarifa Beach Houses have air conditioning. Air-conditioning will only

be effective if all doors and windows are closed whilst it is running. We cannot be held responsible for non- effective air conditioning if this simple procedure is not followed. The air-conditioners are extremely effective and cool a room down in minutes. In the interests of saving energy, we strongly recommend that the air-conditioners be turned off when leaving the room.

Condition of the Facilities at the Tarifa Beach Houses

Neither Tarifa Beach Houses, or the Owner, shall be liable for any defect in or the breakdown of any mechanical, electrical or other item of equipment, goods or property, including the property itself or the swimming pool. However upon becoming aware of the defect the Owner, shall endeavour to effect repairs to / or the replacement of any such item within a reasonable time frame. The client shall not be entitled to any compensation whatsoever in respect thereof.

We cannot be held responsible for the failure of public utilities such as water and electricity. We cannot be held liable for any malfunctions or technical problems with Internet Service Providers.

Noise

We cannot be held responsible for noise or disturbance originating beyond the boundaries of the property or which is beyond our control.

Animals, bugs etc

Tarifa Beach Houses shall not in any way be liable for the occasional appearance at a Tarifa Beach House property of insects, vermin or animals, but shall endeavour to limit or eradicate the same when notified of their presence.

Allergies

We do not recommend that you stay in a countryside property if you have allergies to animal hair. In the spring we have lots of wild flowers in the Tarifa countryside so hay fever sufferers or clients with pollen allergies should reconsider visiting at this time of year or stay in town.

Safety

Upon arrival at the property you and all members of your party must take time to familiarise yourselves with the location and layout of the property. Telephone numbers for the emergency services are given to all guests in the information packs.

Smoking

No smoking is allowed inside a Tarifa Beach House. Please do not throw cigarette ends, it is a massive fire hazard and most properties are within the Natural Park.

Website Content and Photos

The majority of the Tarifa Beach Houses are people’s homes, the information on the website is intended as a guide only. We cannot accept responsibility for any inaccurate, misleading or incomplete information about any property and its facilities or services. Property owners have the right to change decoration as they choose.

A breach of the Terms and Conditions

In the event of a breach of the above terms and conditions by the client the Owner may in their absolute discretion terminate the agreement forthwith, and the client shall be liable to compensate the owner for any loss or damage incurred.

Insurance
It is an express condition of booking that all party members must have adequate personal liability, accident, medical and cancellation insurance. The Owner will in no way be liable in the event of any party member’s failure to take out such insurance.
